General

How does a timeshare contract function?
When you enter into a time share agreement you are agreeing to pay for your vacation in advance. Whether it’s a unit in a luxury resort, an apartment, or some other dwelling unit the timeshare buyer is being given the option to use the property for a fixed amount of time per year, typically one week per year. The part that is not usually fully explained to the buyer is that they will be obligated to paying a mortgage with a high interest rate, as well as ever growing usage fees for maintenance, and even special assessments for use of the timeshare during peak periods.
Am I buying property when I buy a timeshare?
Most timeshare properties today operate on a point system whereby you accrue timeshare points that you exchange for timeshare property usage. With these types of timeshare contracts, you can very quickly find out that the timeshare you thought you were buying for 300 dollars a day rises to 500 or even 600 dollars per day when the timeshare operator changes the valuation of your timeshare points. Alternatively, some timeshare operators to sell timeshares that purport to be deeded property. In reality what you are buying is not title to property but rather the right to usage of property for one to two weeks a year.
How can I get rid of my timeshare and cut my losses?
Only a small percentage of timeshare contracts provide the buyer with the right to resell their timeshare. Moreover, because so many people have been scammed into buying a timeshare, there is a glut of sellers and a paucity of buyers, not to mention scammers claiming to buy and sell timeshares.
Can a timeshare operator sue me if I stop paying them? Can a timeshare company garnish my wages if I stop paying?
Yes, as they say, anyone can sue anyone, but only if they get a judgment against you can they actually attempt to collect or garnish wages from you. Our goal as attorneys is to protect you from any such action, by establishing that your agreement to sign the timeshare contract was obtain through fraud or mistake that voids the contract and makes it unenforceable.
Is there and end point to a timeshare contract?
Timeshare contracts generally purport to last for the lifetime of the buyer and can be passed on to heirs. But with that said, not many people will be thanking you for leaving them the financial burdens associated with a timeshare. This is so because the mortgage and maintenance fees don’t stop when you pass away, and the timeshare operator can even make a claim against your estate by way of foreclosure, thereby devaluing what you leave to your heirs, even if they reject the timeshare contract you bequeath to them.

Process

How can Brownstone Law Group help me get out of my timeshare?
Our professionals take the time to understand the particulars of your timeshare agreement paying close attention to collecting the evidence of how you were misled when you first signed the timeshare agreement. We then use our time honed process of negotiations and threat of legal action to get your timeshare operator to release you from.
Does Brownstone Law Group buy and sell timeshares? Can you help me sell my timeshare?
No, as a law firm, representing you, we are ethically prohibited from doing so. Even if we were not prohibited, there are very few interested buyers.
What is the process for ending my timeshare with the help of Brownstone Law Group?
1. The process starts with our staff conducting a thorough interview of you to learn as much of the details as we can about how you came to own your timeshare. That interview will include a cost analysis of your timeshare to document how much you were told the timeshare would cost compared to what it actually costs you now and over time. We will then present you with a quote of the fees and costs associated with retaining our firm to help you. If you are prepared to move forward, we will begin the paperwork and intake process with you. We will also help you with any research you feel you need to do before making any decision to retain us.

2. If you decide to retain us, we will assign your case to one of our trained professionals, and an attorney will review your file before implementing our plan of action to end your timeshare once and for all. Initially we will need to obtain documentation (evidence) from you about your timeshare. Our staff are trained to know exactly what to ask for, and to help you gather the evidence we will need to end your timeshare. As we accumulate that evidence, we use our proprietary system to manage the data, and move your case through our legal process designed to create pressure on your timeshare operator to agree to terminate your timeshare. We understand that the timeshare ownership experience has created unwanted stress in your life, and our staff of do everything in their power to minimize the stress of trying to unwind your timeshare. We do this by giving you frequent updates of where you are in the process, and answering all your question in a timely fashion. We understand that the negotiation process is often lengthy, and our goal is to make sure that your expectations are in line with the reality of the time involved in terminating a timeshare. That time frame can last anywhere from six months to 24 months, depending on the facts of your case. In the end, the goal is to present you with a timeshare cancellation agreement whereby your timeshare operator terminates your timeshare on terms acceptable to you. Once that occurs, you are officially out of your timeshare, and all associated obligations.

How quickly can I get out of my timeshare?
There is no set timeframe for every case. It will depend on variable such as how long you have owned your timeshare, how the timeshare agreement reads, the evidence of fraud by the timeshare operator. We can only provide a more specific timeframe after reviewing the evidence in your case.
Can I terminate my timeshare by myself?
Most consumer contracts have a “right of rescission” built into them for a short period just after the contract is entered into. After that period expires, it is highly improbable that you will be able to end your timeshare on your own. Once Brownstone gets involved and begins undertaking legal action timeshare operators have more pressure upon them to negotiate in good faith to end your timeshare agreement. On your own it is unlikely that your timeshare operator will be motivated to act at you request.
Will you be filing a lawsuit against my timeshare company?
In some circumstances, filing a legal action is necessary, and as attorneys we will evaluate what is the best option to represent you. Often, we can negotiate a resolution without filing a lawsuit, which ultimately save you time and money.
How successful are you at ending timeshares?
Our extensive underwriting process ensures that we only agree to represent you if we know we can help you. That is why we offer a money back guarantee if we fail to get you out of your timeshare agreement.

Fees and Costs

What are your fees?

Our fees are determined based upon the costs associated with your timeshare. In other words, the complexity and costs of your timeshare are used to calculate your damages and allow us to estimate the resources we will need to devote to your case to obtain a favorable result. The complexity of your situation will allow us to predict what the likely response by your timeshare operator will be and what the appropriate fees for services should be. Everything is explained up front, and all fees are disclosed and approved by you before we get paid. Once we are retained, we take on full responsibility to complete your file within 24 months. You can reach us at 888-853-8871 or info@brownstonelawgroup.com

Can’t I just stop paying the timeshare company and be done with it. Why should I pay more money in attorney fees after paying lots of money to the timeshare company?
Just stopping payments to the timeshare operator very rarely results in them just going away. You signed a contract, and without taking the necessary steps to terminate that contract based upon you being defrauded by the timeshare company, they will simply continue to enforce the contract against you through legal action of their own. Even if your mortgage is paid off, they can sue you for the ongoing maintenance fees and special assessment fees in most timeshare contract. By proactively taking action, you can protect your legal rights, and have your timeshare company more concerned about what you can do to them than they are about continuing to fleece you for fees. Doing nothing only emboldens them to pursue their claims under the contract, which will cost even more over time, with no end in sight.
Will canceling my timeshare affect my credit score?
Not if we can help it. First and foremost, there is no way to predict what any given timeshare operator will report to a credit bureau. However, as part of our process, we help you dispute any alleged entry a timeshare operator or their collectors attempt to have posted on your credit. If your timeshare operator violates the Fair Credit Reporting Act, we are trained to spot it and put a stop to it. We however cannot guarantee that your credit score might be affected by the actions of your timeshare operator, but we will do everything in our power to respond to it, and put a stop to it.
